Terms of service

These terms are the agreement between Apexly and the business that uses it. They are written to be read. If something is unclear, ask us at support@apexly.dev before you rely on it.

The agreement

Apexly ("Apexly", "we", "us") is operated by Vijay Tambe. By creating an account or using the API you agree to these terms on behalf of the business you represent ("you"), and you confirm you are at least 18 and allowed to bind that business. Our Privacy policy and Acceptable use and abuse policy are part of these terms.

The service

Apexly lets software products give their customers custom domains: we verify DNS, obtain and renew TLS certificates, and route traffic for those domains to your origin, adding a signature you can verify. We provide a dashboard, an API, webhooks and a connect page your customers can use.

Accounts

  • Keep your sign-in methods, API keys and signing secrets confidential. You are responsible for activity under your account and keys.
  • Tell us promptly at support@apexly.dev if you think your account or a key is compromised; revoke the key in Settings.
  • Give us accurate contact details so we can reach you about your domains and the service.

Your domains

  • Only register hostnames that you or your customer control, and only with their permission. By registering a hostname you authorize us to request certificates for it from certificate authorities and to serve traffic for it.
  • Your origin, its content and your relationship with your customers are your responsibility.
  • Certificates are published in public Certificate Transparency logs, so registered hostnames become publicly visible.
  • Some outcomes depend on things outside our control: your customers' DNS settings, certificate authorities and their rate limits. We explain every problem we detect and how to fix it.

Acceptable use

You must follow our Acceptable use and abuse policy. In short: no phishing, malware, impersonation, spam or illegal content, and no attempts to break, overload or get around the limits of the service. You are responsible for how your customers use the domains you serve through Apexly.

Plans, launch offer and fees

  • Launch offer. During launch, new accounts receive the Free promotional license: up to 20 live domains with no charge. The offer is aimed at our first 20 customers; we may end it for new sign-ups at any time. If we ever end or change the license on an existing account, we will give at least 30 days' notice by email.
  • Free plan. Up to 3 live domains. Live API keys may require an upgrade.
  • Paid plans are priced on our pricing page. Until card payments are switched on, upgrades are arranged by email at support@apexly.dev; the price and term we confirm in writing apply. Fees are exclusive of taxes.
  • Usage is measured as the daily average of live domains plus egress above your plan's allowance, as described on the pricing page.

Availability

We work hard to keep the service fast and available, and we keep serving existing domains even if our dashboard or API is down. During launch the service is provided without a service-level agreement unless we sign one with you in writing. We may change or remove features; we will give reasonable notice of changes that materially reduce the service you use.

Your data

You own the data you give us. We use it only to provide and secure the service, as described in the Privacy policy, and we process data about your customers' visitors on your behalf. You can export or delete your data, and close your account at any time.

Suspension and termination

  • We may hold a domain or suspend an account immediately to stop abuse, protect others or comply with the law. We tell you why unless the law forbids it, and lift the hold if the issue is resolved.
  • We may end these terms for a serious or repeated breach after notice and a reasonable chance to fix it, where a fix is possible.
  • You may stop using the service and close your account at any time.
  • When an account closes, its domains stop being served and their certificates are deleted.

Intellectual property

We own Apexly, its software and its brand. You may use the service and its documentation for your business during your subscription. If you send us feedback, we may use it without obligation to you.

Disclaimers

Except as stated in these terms, the service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, neither side is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising from these terms is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You will defend and indemnify us against third-party claims arising from content served through your domains or from your breach of the Acceptable use policy.

Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute.

Changes

We may update these terms. We post the new version here with a new date and, for material changes, email account owners at least 30 days before they apply. If you keep using the service after that, the new terms apply.
